Claims & Returns Policy

Effective from March 1, 2025

1. Introductory Provisions

This Claims Policy regulates the rights and obligations of the contracting parties when claiming liability for defects and is an integral part of the General Terms and Conditions (GTC) of the seller. It is drawn up in accordance with Act No. 89/2012 Coll., the Civil Code, as amended, and Act No. 634/1992 Coll., on Consumer Protection, as amended.

2. Liability for Defects and Time Limits

  1. The Seller remains liable to the Buyer that the goods are free from defects upon handover.
  2. New goods: The Buyer is entitled to exercise the right arising from a defect within 24 months from the handover.
  3. Used goods: The parties agree to shorten the period for exercising rights arising from defective performance to 12 months from the handover. The Seller is liable only for defects present at the time of handover.
  4. If a defect becomes apparent within one year from the handover, the goods shall be presumed to have been defective already upon handover, unless the nature of the goods or the defect precludes it.
  5. No claim can be made for defects which the Buyer was explicitly notified of before concluding the contract or which the Buyer had to have known considering the nature of the used goods.

3. Specifics of Used Luxury Goods and Watches

The Buyer acknowledges that the condition of the used goods corresponds to their age and previous wear. The following are specifically NOT considered defects:

  • Standard wear and tear, hairline scratches, micro-abrasions, and cosmetic imperfections,
  • For mechanical watches, a standard timing deviation within the manufacturer's tolerances,
  • Limited or reduced water resistance (water resistance is not a true permanent characteristic, and in used goods it may be limited due to gasket degradation),
  • The fact that the watch may have been serviced, polished, or repaired in the past,
  • Battery discharge in quartz watches after delivery.

4. Acceptance Inspection (Shipping)

  1. The Buyer is obliged to check the integrity of the packaging upon receiving the shipment.
  2. If the Buyer discovers damage caused by transport, they are obliged to report this immediately (no later than 24 hours after receipt) to the carrier and the Seller.
  3. Later claims of mechanical damage (e.g., shattered crystal, deep gouges) not reported immediately upon delivery will be disregarded.

5. Withdrawal from Contract (Online Purchases Only)

  1. When purchasing online, the consumer has the right to withdraw from the contract without giving any reason within 14 days from the date of handover.
  2. The Buyer is liable for any reduction in the value of the goods resulting from handling them otherwise than necessary to familiarize themselves with the nature and functionality of the goods (e.g., wearing, cutting the bracelet/strap, damaging the original packaging, certificate or presentation box).
  3. If returned goods show signs of new damage or wear not present at the time of sale, the Seller is entitled to reduce the refunded amount by the cost required to restore the goods.
  4. The right to withdraw from the contract without giving reasons does not apply to in-store boutique purchases.

6. Exclusion of Liability

A claim will not be accepted if:

  • Mechanical damage occurred due to the Buyer's handling after handover,
  • An unauthorized service center or third party interfered with the mechanism,
  • Serial numbers or protective elements were tampered with or removed,
  • The defect was caused by improper usage, poor maintenance, or external factors (e.g., impact, strong magnetic fields, water ingress contrary to resistance ratings).

7. Claim Resolution

  1. Claims can be made in person at the boutique address or by sending the goods to the claims address along with a description of the defect and proof of purchase (invoice or receipt).
  2. The Seller will decide on the claim immediately, and in complex cases no later than within 3 business days. The claim will be fully processed no later than 30 days from its filing.
  3. For used goods, the Seller prefers to repair the defect; if repair is not feasible, they will provide a reasonable discount or proceed to withdraw from the contract.

8. Out-of-Court Settlement

In the event of a dispute, the consumer may contact the Czech Trade Inspection Authority (www.coi.cz) for out-of-court dispute resolution (ADR).
