- The Buyer acknowledges that the condition, functionality, and appearance of the goods correspond to their age and prior use. A detailed description of the condition, authentic photographs, and accessory details are an integral part of the listing.
- Minor signs of normal wear and tear (hairline scratches, light scuffs, worn straps or crowns, etc.) are not considered defects.
- The Seller guarantees the functionality of the mechanism within the scope of legal rights for defective performance (see Section 7 and the Claims Policy).
3. Ordering and Contract Conclusion
- The contractual relationship begins upon order confirmation by the Seller (via confirmation email).
- The Seller reserves the right to reject an order without providing a reason, especially in the event of stock depletion, an obvious pricing error, or suspected fraud.
- After order confirmation, the goods are reserved for 3 business days pending payment. The reservation may be canceled if payment is not received within this period.
4. Payment Terms
The purchase price can only be paid:
- By bank transfer to the Seller’s account (payment details are provided in the order confirmation).
- In cash upon personal collection at the boutique (Moskevská 7, Prague – Vršovice).
Goods will only be dispatched or prepared for collection once the full purchase price is credited to the Seller’s account.
5. Shipping and Delivery
- Goods are shipped via contracted carriers (e.g., PPL, Zásilkovna, Czech Post) or can be collected in person at our boutique.
- The Buyer is obliged to properly inspect the integrity of the packaging and any visible damage upon taking delivery of the goods.
- Any transport-related damage must be reported by the Buyer immediately (no later than 24 hours after delivery) to both the Seller and the carrier. Later claims regarding shipping damage will not be accepted.
- Risk of damage to the goods:
- For consumers, risk passes upon taking delivery from the carrier.
- For business entities, risk passes at the moment goods are handed over to the first carrier.
6. Withdrawal from Contract (Distance Selling for Consumers Only)
- The consumer has the right to withdraw from the online purchase contract without giving a reason within 14 days of taking delivery of the goods (or the final component for multi-part orders).
- Goods must be returned in their original condition, no later than 14 days after withdrawal, to: Moskevská 7, Prague – Vršovice, 101 00. The consumer bears all costs associated with returning the items.
- The Seller will refund the purchase price (including the initial delivery costs to the consumer) within 14 days of receiving the withdrawal notice, using the same payment method. However, the Seller is not obliged to refund funds until the goods are received or proof of dispatch is provided.
- Reduction in Value: If the returned goods show signs of wear, damage, contamination, lack the original packaging, box, certificate, protective film, or other accessories, or if they have been altered (e.g., shortened bracelet, replaced parts), the Seller is legally entitled to deduct an amount corresponding to the reduction in value or the costs of restoring the item to its original state. The amount to be deducted will be communicated to the Buyer in writing.
7. Claims and Rights Arising from Defective Performance
- Rights from defective performance are governed by the Civil Code and the Seller's Claims Policy, which forms an integral part of these GTC.
- For used goods, the period for asserting claims from defective performance is 12 months from the date of delivery.
- The Seller is not responsible for defects that:
- correspond to the level of wear or age of the goods upon delivery (particularly minor imperfections visible in descriptions or photos),
- were caused after delivery by improper use, unauthorized interference, lack of maintenance, or external influences.
- Claims must be reported without undue delay after the defect is discovered, but no later than the period stated in Article 2.
8. Final Provisions
- These GTC and all associated legal relationships are governed by the laws of the Czech Republic.
- Out-of-court resolution of consumer disputes is provided by the Czech Trade Inspection Authority (www.coi.cz).
- By submitting an order, the Buyer confirms they have read, understood, and fully agreed to these GTC, the Claims Policy, and the conditions of sale.
- The Seller reserves the right to unilaterally amend these GTC. The new version is effective upon publication on the online store website. Prior accepted orders are governed by the GTC version valid at the time of confirmation.
- If any provision of these GTC is held invalid or unenforceable, the validity of the remaining provisions remains unaffected.
- These GTC take effect on March 1, 2025, and supersede all previous versions.
